CLAIMS LITIGATION/SUBROGATION SPECIALIST ADJUSTER
Responsible for the handling of moderately to complex subrogation and property damage litigation files. Identify and pursue opportunities for subrogation while exercising good economic judgment. This person should be a negotiator who is knowledgeable in Automobile, Residential and Liability claims, the litigation process and the alternate dispute resolution process (arbitration). They should be able to facilitate the resolution of files in dispute following the Company's philosophy on claims handling. Responsible for a number of analysis and assessment functions with regards to claims, liability and reserves.
EDUCATION LEVEL REQUIRED University degree/college diploma preferred or equivalent business experience. YEARS OF EXPERIENCE REQUIRED 3 to 5 years claims handling SPECIFIC EXPERIENCE - Minimum of 3 years adjusting experience - Proficiency in the litigation process - Excellent communication and interpersonal skills - Proficiency in a variety of P.C. software
MAJOR ACCOUNTABILITES Subrogation Handle files from adjusters involving recovery from a third party by investigating and establishing the possible level of recovery or payment. Analyse claims for possible legal proceedings and collections process. Negotiate settlement by phone or directly with third parties to ensure recovery or payment reflective of our exposure/risk. Handle and manage arbitration and inter-company mediation files. Follow up by recovering amounts owed and in certain situations negotiate a repayment schedule. Act as a resource for peers and assist in training.
Litigation Appropriately identify files that are to be referred to defence counsel. Respond to and monitor the handling of files that are in the alternate dispute resolution and litigation process. Provide appropriate direction to defence counsel. Actively participate in the proceedings as necessary (Examinations, Discoveries, Pre-Trial Conferences) This employee will represent the company at the majority of the alternative dispute and small claims court proceedings. Regularly document on each file they litigate or defend. This employee will also produce a record keeping report on all of the files in this process. Negotiate resolutions reflective of our exposure/risk. Act as a resource for peers and assist in training.
